These Terms of Service ("Terms") constitute a binding legal agreement between you ("you", "User") and Blackperp, based in Amsterdam, the Netherlands ("Blackperp", "we", "us"), governing your access to and use of the Blackperp website, dashboard, AI analyst, and related services (the "Service").
By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Risk Disclosure.
Blackperp provides a real-time crypto perpetual futures analytics platform comprising market data aggregation, algorithmic signal generation, zone analysis, an AI analyst chat interface, news summarization, and supporting educational content.
The Service is an informational and analytical tool only. It does not constitute investment advice, financial advice, a recommendation to buy or sell any asset, or a solicitation of any transaction. See Risk Disclosure for the full disclaimer.
To use the Service, you must:
You must register an account with a valid email address and verify ownership of that email. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. Notify us immediately at [email protected] of any unauthorized access.
One account per natural person. Sharing accounts, automating access, or reselling Service output is prohibited and may result in immediate termination without refund.
The Service is offered on a subscription basis (Core, Pro, Black) with monthly billing in EUR, plus optional one-time credit top-up purchases. All payments are processed by Stripe, Inc.
Under Dutch consumer law (Burgerlijk Wetboek, Boek 6, art. 230o), EU consumers have a 14-day right of withdrawal for digital services. By creating an account and beginning use of the Service, you expressly request that performance begin during the withdrawal period and acknowledge that you waive your right of withdrawal once performance has commenced.
Outside the statutory withdrawal period, subscription fees and credit purchases are non-refundable except where required by law or at our sole discretion in cases of genuine service failure.

All content on the Service — including software, signals, zone outputs, articles, code, design, brand marks, and methodology — is the exclusive property of Blackperp or its licensors and is protected by Dutch and international copyright, trademark, and trade-secret law.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial trading research. No other rights are granted.
Feedback you submit (suggestions, bug reports, ideas) may be used by us without restriction and without compensation to you.
Portions of the Service — including the AI analyst chat, news rewriting, and certain commentary — are generated by large language models (currently Anthropic Claude via OpenRouter). AI output may contain errors, omissions, hallucinated facts, outdated information, or misinterpretation of input data.
You are solely responsible for verifying any AI-generated information before acting on it. We make no warranty as to the accuracy, completeness, or fitness for purpose of AI output. See §10 (Disclaimer) and §11 (Limitation of Liability).
The Service aggregates data from third-party sources including Binance, Hyblock, Deribit, Polygon, DefiLlama, CoinGecko, OKX, Bybit, Hyperliquid, mempool.space, Alternative.me, and others. We do not control these sources and cannot guarantee data accuracy, completeness, latency, or continuous availability. Outages, API changes, or upstream errors may temporarily affect Service functionality.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
NOTHING ON THE SERVICE CONSTITUTES INVESTMENT, FINANCIAL, LEGAL, TAX, OR ACCOUNTING ADVICE. THE SIGNALS, ZONES, AND COMMENTARY ARE INFORMATIONAL ONLY. PAST PERFORMANCE OF ANY METRIC OR BACKTEST DOES NOT GUARANTEE FUTURE RESULTS. TRADING CRYPTOCURRENCIES AND DERIVATIVES INVOLVES SUBSTANTIAL RISK OF LOSS.
TO THE MAXIMUM EXTENT PERMITTED BY DUTCH LAW, BLACKPERP, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, TRADING LOSSES, MISSED OPPORTUNITIES, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED EUROS (€100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under Dutch law.
You agree to indemnify and hold harmless Blackperp from any third-party claim, loss, liability, or expense (including reasonable legal fees) arising from (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any trading decision you make based on Service output.
We may suspend or terminate your account immediately and without notice if you breach these Terms, abuse the Service, charge back a payment, or for any conduct we determine in our reasonable discretion to be harmful to other users or to the Service. Pre-paid fees for the unused portion of the current billing period are forfeit upon termination for breach.
You may terminate your account at any time via the Account page. Upon termination, all licenses granted to you end immediately.
We may revise these Terms from time to time. We will notify active subscribers of material changes at least 30 days in advance via email. Continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes. If you do not agree to revised Terms, your sole remedy is to cancel your subscription.
These Terms are governed by the laws of the Netherlands, excluding its conflict-of-laws rules and excluding the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, without prejudice to the mandatory consumer rights granting EU consumers the right to bring proceedings in the courts of their place of residence.
